These Terms of Service (“Terms”) govern your use of the websites, mobile applications, radio streams, forms, events, promotions, content, and related services operated by DTB Group LLC, doing business as Power JDM The Beat (“Power JDM,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you may use the Services only with permission from a parent or legal guardian. The Services are not directed to children under 13.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for lawful purposes. You may not violate applicable law; interfere with the Services; gain unauthorized access; copy, scrape, distribute, or commercially exploit content without permission; upload malicious code; impersonate others; harass or defame anyone; distribute spam; or circumvent security or access controls.
Power JDM provides live and recorded radio, music, interviews, podcasts, videos, events, news, commentary, and entertainment content. Programming, schedules, hosts, artists, availability, and features may change without notice. We do not guarantee uninterrupted streaming or the availability of any particular program. Views expressed by hosts, guests, artists, and advertisers do not necessarily represent Power JDM.
You may submit music, recordings, photographs, videos, biographies, artwork, interviews, and promotional materials (“Submitted Content”). You retain ownership of your Submitted Content. By submitting it, you grant Power JDM a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, format, stream, broadcast, publicly perform, display, promote, distribute, and use it in connection with Power JDM programming, marketing, social media, websites, applications, and events.
You represent that you own or control all necessary rights and permissions, including permissions from performers, producers, photographers, writers, labels, publishers, and featured individuals. Submission does not guarantee airplay, publication, promotion, compensation, an interview, or any other opportunity.
Power JDM’s name, logos, branding, graphics, website design, station imaging, original text, videos, and software are owned by or licensed to Power JDM and protected by intellectual-property laws. Music and other third-party content remain the property of their respective owners. You may not use Power JDM branding or content commercially without written permission.
A copyright complaint should identify the copyrighted work and disputed material, provide the complaining party’s contact information and signature, and include statements of good-faith belief, accuracy, and authority to act for the rights holder. Send notices to: DTB Group LLC, Attn: Copyright Agent, 600 N. Broad Street, Middletown, DE 19709. Power JDM may remove disputed material and restrict repeat infringers.
Advertising, sponsorships, promotional campaigns, artist packages, and paid services may be governed by a separate agreement, proposal, order, or invoice. Unless guaranteed in writing, Power JDM does not promise any specific number of listeners, impressions, leads, sales, streams, followers, or other results. Advertisers are responsible for the legality and accuracy of their materials and claims.
Events, contests, giveaways, tickets, and promotions may have additional rules, eligibility requirements, deadlines, releases, and purchase terms. Promotion-specific rules control if they conflict with these Terms. Schedules, venues, and participants may change.
We may contact you about inquiries, submissions, advertising, programming, events, account activity, and support. Marketing messages are sent only as permitted by law and your preferences. Message and data rates may apply. You may use an unsubscribe link or reply STOP to supported text-message programs.
The Services may link to third-party websites, social networks, streaming providers, payment processors, or advertisers. Power JDM does not control and is not responsible for their content, availability, security, or privacy practices.
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Power JDM disclaims express and implied warranties, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and uninterrupted operation.
To the fullest extent permitted by law, Power JDM and its owners, officers, employees, contractors, hosts, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Power JDM’s total liability will not exceed the greater of the amount you paid directly to Power JDM during the six months before the claim or $100. These limits do not apply where prohibited by law.
You agree to defend, indemnify, and hold harmless Power JDM and its owners, officers, employees, contractors, hosts, affiliates, and representatives from claims and expenses arising from your use of the Services, Submitted Content, violation of these Terms, infringement of another person’s rights, or advertising and promotional claims.
We may suspend or terminate access if we reasonably believe you violated these Terms, created legal or security risks, infringed third-party rights, or misused the Services.
These Terms are governed by Delaware law without regard to conflict-of-law rules. Disputes will be brought in a state or federal court with jurisdiction in Delaware. Before filing a claim, the parties will attempt in good faith to resolve it informally for at least 30 days after written notice.
If a provision is unenforceable, it will be modified or removed to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. These Terms, our Privacy Policy, and applicable written service agreements constitute the entire agreement concerning the Services.
